FoodLore Terms of Use

1. Acceptance of Terms

By downloading, installing, or using FoodLore ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms supplement the Apple Licensed Application End User License Agreement (Standard EULA). In the event of a conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA shall prevail.

2. App Description

FoodLore is a nutrition and wellness information app that uses artificial intelligence to analyze food and provide nutritional data alongside Traditional Chinese Medicine (TCM) food wisdom. The App is designed for informational and educational purposes only.

3. Subscriptions & Payments

FoodLore offers auto-renewable subscriptions to access its features:

• Monthly Premium: $7.99 per month
• Yearly Premium: $39.99 per year

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

4. Free Trial

FoodLore offers a 3-day free trial for new subscribers. During the trial, you have full access to all premium features. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the subscription price.

To avoid being charged, cancel at least 24 hours before the trial period ends via Settings > Apple ID > Subscriptions on your device.

5. Acceptable Use

You agree to use FoodLore only for lawful, personal, non-commercial purposes. You shall not:

• Reverse engineer, decompile, or disassemble the App
• Use the App to provide medical advice or diagnosis to others
• Attempt to bypass subscription requirements or manipulate the App's functionality
• Use the App in any way that could damage, disable, or impair its services
• Redistribute, sublicense, or commercially exploit the App or its content

6. Health & Medical Disclaimer

Always consult a qualified healthcare provider before making any dietary changes or health decisions. Do not disregard professional medical advice or delay seeking it because of information provided by the App.

The TCM constitution assessments, tongue analysis results, and food recommendations are educational and should not be considered substitutes for professional TCM consultation or Western medical evaluation.

Nutritional estimates provided by AI analysis are approximations and may not be accurate for all foods, portions, or preparation methods.

7. AI-Powered Services

FoodLore uses third-party AI services (including OpenAI and Anthropic) for food recognition, nutritional analysis, and health insights. By using these features, you acknowledge that:

• AI-generated results are estimates and may contain inaccuracies
• Food photos and tongue images are transmitted to AI providers for processing
• Personal health data is only sent to approved US-based AI providers with your explicit consent
• AI analysis results may vary between sessions as models are updated

8. Intellectual Property

FoodLore and its original content, features, and functionality are owned by FoodLore and are protected by international copyright, trademark, and other intellectual property laws. The App's design, logos, text, graphics, and code are proprietary.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App ceases immediately.

You may stop using the App at any time by deleting it from your device. Deleting the App will remove all locally stored data. To stop subscription charges, cancel your subscription through your Apple ID settings before deleting the App.

10. Disclaimers & Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOODLORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH OUTCOMES, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

FoodLore does not guarantee the accuracy, completeness, or usefulness of any nutritional data, AI analysis, or TCM information provided through the App.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

We encourage you to review these Terms periodically for any changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.
